A title company provides services for real estate closings, such as searching the title of a subject property to discover any encumbrances, liens, and anything needed to be resolved before closing. It also serves as an escrow agent and is the center point for a closing for all relevant parties, such as the buyer, seller, real estate agents, and lenders.
Once a title company investigates title and liens, it will draft a document called a title commitment. This title commitment will include a list of issues found in the title and lien search, such as a mortgage, city lien, etc. The title company will process this and provide solutions to clearing title. Once everything can be checked off, the property will have all issues cleared and the title insurer will provide insurance to protect the owner and/or lender.
Usually, the party who chooses the title company will pay for title insurance. However, each county has its own custom when dealing with closing costs. In most counties in Florida, the Seller chooses and pays for the title insurance. However, there are some counties, such as Miami-Dade, where it is customary for the Buyer to choose the title company and pay for title insurance. This can also be negotiated in the contract.
